The federal register is the easy part. The expensive surprises come from common law use — a business that never registered but has been using the name in commerce longer than you have — and from marks that are not identical but are confusingly similar. We look at all three and write you an assessment you can act on.
Since January 18, 2025 the USPTO base fee is $350 per class. Write your own description of goods and services instead of using the ID Manual and it becomes $550 — a $200 surcharge per class. Leave information out and it is another $100. We draft from the ID Manual, which is why our package prices what it prices.
If you are domiciled in the United States, you may file your own application — the USPTO permits it. If you are foreign-domiciled, you must be represented by a U.S.-licensed attorney; that has been the rule since August 3, 2019, and for a company your domicile is your principal place of business, not your state of formation. If you are in that second group we tell you at intake and refer you to a U.S. attorney rather than sell you a package you cannot use.
